Tuition Agreement: This Registration and Tuition Agreement represents the entire agreement between the parties and supersedes all previous agreements and understandings, written or oral, between the parties with respect to the subject matter. The terms of this Registration and Tuition Agreement may not be modified, waived, renewed, or discharged except in a writing signed by both parties. No failure or delay by Heart of Singing, Inc. in enforcing any right under this Registration and Tuition Agreement will operate as a waiver of that right or prevent Heart of Singing, Inc. from exercising that right at another time or any other right under this Registration and Tuition Agreement. This Registration and Tuition Agreement shall be governed by the laws of the State of Illinois, without regard to its conflict of laws principles to the extent they would require the application of another state’s law. In the event that any provision of this Registration and Tuition Agreement shall be held unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of this Registration and Tuition Agreement shall remain in effect. This Registration and Tuition Agreement is non-refundable by the undersigned. Failure to pay will result in this account being turned over to our collection agency for further action, including but not limited to reporting to the major credit bureaus. You are responsible for any collection agency and/or legal fees assessed.

Production Release: Student, for himself or herself, or, if Student is a minor as determined by Illinois state law, then the undersigned for and on behalf of the minor Student (for whom the undersigned represents that he or she has full authority as the parent or legal guardian of the minor Student to bind the minor Student to this Production Release), hereby grants to Heart of Singing, Inc. and its affiliates, agents, licensees, successors and assigns, and the officers, directors, employees and agents of each of them (collectively, “HOS”), the irrevocable and unconditional right, permission and license to use Student’s appearance, name, image, likeness, voice, and performance, or if the student is a minor, (collectively, the “Grants”), as embodied in any video production, audio recording, digital files, or photographs, in any and all manner and media for any purpose, including, without limitation, broadcasting, advertising, marketing, commercial purposes, and publicity purposes, throughout the world and in perpetuity, without territorial, time, use, or other limitations (the “Production”). This grant includes, without limitation, the right to edit, mix, adapt, alter, modify, change, reproduce, duplicate, copy, publish, transmit or distribute and to use or reuse the Grants, in whole or in part, in connection with the Production or any part of it. Student, for himself or herself, or, if Student is a minor as determined by Illinois state law, then the undersigned for and on behalf of the minor Student, understands that he or she is not entitled to any royalties or other compensation in connection with the Production. HOS shall own all rights, title and interest, including without limitation, the copyright and any other intellectual property rights, in and to the Production including, but not limited to, all video, film, audio and visual recordings and photographs. To the extent that Student owns any copyrights in the Production based on Student’s contribution to the Production, Student, for himself or herself, or, if Student is a minor as determined by Illinois state law, then the undersigned for and on behalf of the minor Student, hereby assigns all right, title and interest in and to my copyrights in the Production and waives any moral rights Student may have therein. Student, for himself or herself, or, if Student is a minor as determined by Illinois state law, then the undersigned for and on behalf of the minor Student, hereby releases, discharges and agrees to hold harmless HOS from any and all rights, claims, demands and actions which Student’s heirs, executors, administrators or assigns may have in connection with the use of any Grants including those based on invasion of privacy, defamation, or any other cause of action arising out of this Release and/or the production, reproduction, distribution, use or exhibition of the Grants, distortion or optical illusion arising from the reproduction process, the composite nature of the use or otherwise.

Waiver and Release. Student, for himself or herself, or, if Student is a minor as determined by Illinois state law, then the undersigned for and on behalf of the minor Student (for whom the undersigned represents that he or she has full authority as the parent or legal guardian of the minor Student to bind the minor Student to this Waiver and Release), voluntarily agrees to participate in the program or programs selected. The undersigned represents that he or she, or the minor Student, is in good physical condition and does not suffer from any disability that would prevent or limit the undersigned or the minor Student from participation in the programs selected. In consideration of the opportunity to use Heart of Singing, Inc.’s facility and to participate in the programs offered by Heart of Singing, Inc. or its employees, representatives, consultants or agents, whether at Heart of Singing Inc.’s facility or elsewhere, on Student’s own behalf and on behalf of his/her heirs, executors, successors and assigns, hereby waives and releases to the fullest extent permitted by law, all claims, charges, causes or rights of action, demands, judgments, verdicts, suits at law or in equity or otherwise, and all liability for personal, compensatory or punitive damages the undersigned and/or Student (if Student is a minor) now has or may have at any point in the future against Heart of Singing, Inc. and all affiliated companies, and its and their successors and predecessors, as well as all of its and their officers, directors, shareholders, employees and agents (each an “Released Party”), arising from or related to the undersigned and/or Student (if Student is a minor), including, without limitation medical expenses, lost wages, pain and suffering, heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, vocal injuries, and any other illness, soreness, or injury, however caused, whether occurring before, during or after the use of Heart of Singing, Inc.’s facility or otherwise before, during or following participation by the undersigned and/or the Student (if Student is a minor) in the program or programs offered by Heart of Singing, Inc. or its employees, representatives, consultants or agents, regardless of fault. The undersigned has read this Waiver and Release, understands all of its provisions, is competent and of legal age.
